FaithPoint AI - Terms of Service

Welcome to FaithPoint AI! Our mission is to bridge the gap between spiritual connection and housing access by leveraging advanced AI technology. We empower individuals, faith-based organizations, and property owners to discover, list, and connect through secure, inclusive, and purpose-driven solutions.

These Terms of Service ("Terms") outline the agreement between you and FaithPoint AI concerning your access to and use of our website, applications, services, and any related content (collectively, the "Platform"). By accessing, registering for, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree with any part of these Terms, you may not use the Platform.

If you are using the Platform on behalf of an organization, you confirm that you have the necessary authority to bind that organization to these Terms, and "you" will refer to both you as an individual and the organization.

Your Agreement with FaithPoint AI

These Terms form a legally binding contract between you and FaithPoint AI. They govern your rights and obligations when using our Platform. By using FaithPoint AI, you are agreeing to these Terms and acknowledge that you have reviewed and understood our Privacy Policy, which explains how we collect, use, and protect your personal data, including through cookies as detailed in our Cookie Policy.

Account Eligibility and Registration

  • Eligibility: You must be at least 13 years old to create an account and use the FaithPoint AI Platform. By using the Platform, you confirm that you meet this age requirement. FaithPoint AI welcomes individuals and organizations of all backgrounds seeking spiritual connection and faith-aligned solutions.
  • Account Creation: To access full Platform features, you must register for an account. You agree to provide accurate, complete, and current information during registration and to promptly update it to maintain its accuracy.
  • Account Security: You are responsible for safeguarding your account password and for all activities that occur under your account. You agree to notify FaithPoint AI immediately if you suspect any unauthorized access or use of your account. FaithPoint AI cannot be held liable for any loss or damage resulting from your failure to protect your account credentials.

Understanding FaithPoint AI Services

  • FaithPoint AI is a digital platform designed to facilitate connections and provide information. Our core services include:
  • Church and Ministry Directories: A searchable database for discovering and connecting with faith-based organizations based on spiritual values, needs, and location.
  • Faith-Based Real Estate Listings: A marketplace for properties (e.g., worship centers, residential homes, land) suitable for ministry or aligned with faith values.
  • Listing Services: Tools enabling organizations and property owners to publish and manage their listings, enhancing their visibility to our audience. We aim to provide accessible tools, including those for users in regions with limited digital literacy.
  • Community and Partner Connections: Features designed to foster relationships between users, spiritual leaders, and potential ministry partners or donors globally.
  • AI Matching: Our Platform utilizes AI to intelligently suggest matches between users and opportunities based on provided preferences.
  • Important Note: FaithPoint AI acts solely as a facilitator of connections and information. We are not a real estate broker, agent, spiritual advisor, financial advisor, legal advisor, or property manager. You are solely responsible for conducting your own due diligence and engaging appropriate professionals for any real estate, legal, financial, or spiritual matters.

Your Content and Listings on FaithPoint AI

  • Ownership: You retain all intellectual property rights in the content, including text, images, and other materials, that you submit, upload, or display on the Platform ("User Content"), including any listings.
  • Responsibilities for User Content: You are solely responsible for your User Content. You represent and warrant that your User Content and listings are accurate, truthful, complete, and do not violate any applicable laws or infringe upon the rights (including intellectual property and privacy rights) of any third party.
  • Grant of License: By submitting User Content to FaithPoint AI, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the operation, promotion, and improvement of the Platform. This license continues even if you stop using the Platform.
  • Prohibited Content: You agree not to upload or share User Content that is illegal, misleading, offensive, infringing, or harmful.

Acceptable Use and Community Standards

  • Use the Platform respectfully and lawfully. You shall not:
  • Use the Platform for any illegal, unauthorized, or malicious purpose.
  • Engage in harassment, abuse, or discrimination.
  • Impersonate others or misrepresent affiliations.
  • Collect data without consent.
  • Interfere with the Platform's integrity or security.
  • Distribute spam or unauthorized solicitations.
  • Overload the Platform infrastructure.

AI Services: Important Considerations

  • AI as a Tool: AI is used to make intelligent recommendations based on provided preferences and data.
  • No Guarantees: Matches are suggestions, not guarantees or professional advice.
  • Your Responsibility: Exercise judgment and verify information before acting.
  • No Automated Decisions: We do not make legally significant decisions using only automated processing.

Payment Terms

  • Pricing Model: Basic access is free. Premium features have fees detailed on our pricing page.
  • Payment Processing: Fees are handled through third-party processors. We do not store your card details.
  • Refunds: Generally non-refundable unless otherwise stated or required by law.

Intellectual Property Rights

  • FaithPoint AI Property: We own the Platform’s intellectual property. You may use it only as permitted.
  • Prohibition on Copying: Do not copy, distribute, or reverse engineer our Platform without permission.

Disclaimers and "As Is" Basis

  • THE FAITHPOINT AI PLATFORM AND ALL SERVICES, INFORMATION, CONTENT, AND MATERIALS PROVIDED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, FAITHPOINT AI EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
  • FAITHPOINT AI DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, RELIABILITY, OR AVAILABILITY OF ANY LISTINGS OR INFORMATION PROVIDED ON THE PLATFORM.
  • No Professional Relationship: Your use of the Platform does not establish any professional relationship (e.g., attorney-client, doctor-patient, spiritual advisor-advisee, realtor-client) with FaithPoint AI.
  • Third-Party Content: FaithPoint AI is not responsible for any User Content or third-party content published on the Platform. Any reliance you place on such content is strictly at your own risk.

Limitation of Liability

  • TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAITHPOINT AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO: (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY OR USER ON THE PLATFORM; (C) ANY CONTENT OBTAINED FROM THE PLATFORM; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF FAITHPOINT AI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • FAITHPOINT AI'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO FAITHPOINT AI FOR ACCESS TO OR USE OF THE PLATFORM DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM; OR (B) FIFTY US DOLLARS (US$50.00).

Your Indemnification Obligation

  • You agree to defend, indemnify, and hold harmless FaithPoint AI, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your access to or use of the Platform; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your User Content caused damage to a third party.
  • This indemnification obligation will survive the termination of these Terms and your use of the Platform.

Termination of Your Account

  • FaithPoint AI may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may do so by following the procedures provided within your account settings or by contacting us.

Third-Party Links and Services

  • The Platform may contain links to third-party websites or services that are not owned or controlled by FaithPoint AI. FaithPoint AI has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We encourage you to review their terms and privacy policies. Your interactions with third-party sites are solely between you and them.

Governing Law and Dispute Resolution

  • a. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. This choice of law does not override any mandatory consumer protection laws that may apply in your jurisdiction.
  • b. Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached within a reasonable timeframe, the parties agree to consider non-binding mediation. If mediation is unsuccessful, the dispute shall be submitted to binding arbitration in Columbus, Georgia, United States, in accordance with the rules of the American Arbitration Association (AAA) then in effect, or as otherwise mutually agreed by the parties. This arbitration provision does not prevent you from bringing issues to the attention of applicable regulatory authorities.

Changes to These Terms

  • FaithPoint AI reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is deemed material, we will provide at least 30 days' notice prior to the new terms taking effect, typically through a notice on the Platform or via email. Your continued access to or use of the Platform after the effective date of any revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Platform.

General Provisions

  • a. Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and FaithPoint AI regarding the Platform's use.
  • b. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • c. No Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
